1. Services Provided
Franklyn Solutions provides technical consulting and support, website design and maintenance, hosting-related services, infrastructure setup, network installation, automation, hardware and software configuration, custom builds, cloud services, branding, troubleshooting, ecommerce/event/business platform solutions, and general technology implementation. Services vary by client and project scope.
2. Estimates, Scope, & Additional Work
Project pricing is based on the scope agreed upon at the time of estimate, invoice, or approval. Requests outside the original scope, including including additional revisions, redesigns, restructuring, expanded functionality, troubleshooting beyond the original request, or additional implementation work, including may require additional billing. Franklyn Solutions reserves the right to determine when requested work exceeds the original agreed scope.
3. Maintenance vs. Development Work
Monthly maintenance or support plans are intended to cover ongoing upkeep, monitoring, hosting-related services, software/platform updates, routine support, and minor adjustments where applicable. Major redesigns, structural revisions, expanded functionality, migrations, extensive troubleshooting, new feature development, large-scale configuration work, or broader implementation projects may be billed separately.
4. Client Responsibilities
Clients are responsible for providing accurate information, approvals, access, credentials, and requested materials; maintaining legal ownership or authorization for devices, accounts, software, and services involved; reviewing completed work within a reasonable timeframe; and maintaining backups of important data unless backup services are specifically included. Delays caused by unavailable access, delayed communication, or missing information may affect timelines.
5. Hardware, Software, & Third-Party Services
Franklyn Solutions frequently works with third-party hardware, software, cloud providers, plugins, APIs, vendors, internet providers, hosting companies, and automation platforms. Franklyn Solutions is not responsible for outages, manufacturer defects, vendor policy changes, licensing limitations, discontinued products, security vulnerabilities, or service interruptions caused by third-party systems or providers. Compatibility between all third-party systems cannot always be guaranteed.
6. Payment Terms
Invoices are due according to the payment terms listed unless otherwise agreed in writing. Franklyn Solutions reserves the right to pause ongoing work, hosting, maintenance, support, or related services on overdue accounts. Administrative fees, card processing fees, late fees, emergency service fees, expedited turnaround fees, or after-hours service charges may apply where applicable.
7. Scheduling & Turnaround Times
Estimated timelines are provided in good faith but are not guaranteed unless specifically agreed upon in writing. Project completion times may vary depending on scope changes, client response times, vendor or platform delays, revision requests, hardware availability, third-party dependencies, and scheduling volume.
8. On-Site & Remote Services
Clients understand that certain services may be performed remotely, on-site, or through third-party remote access software. Clients are responsible for ensuring authorized access to equipment, locations, accounts, or systems when services are scheduled.
9. Data & Backups
While reasonable care is taken during all work performed, Franklyn Solutions is not responsible for accidental data loss, corruption, hardware failure, software conflicts, or unforeseen technical issues. Clients are strongly encouraged to maintain independent backups of important systems and data.
10. Ownership & Deliverables
Upon full payment, clients retain ownership of finalized paid deliverables created specifically for their project unless otherwise agreed in writing. Franklyn Solutions retains ownership of internal workflows, methods, generalized templates, tooling, automation methods, and non-client-specific implementation processes. Franklyn Solutions may utilize non-confidential project examples, screenshots, or generalized work samples for portfolio or promotional purposes unless otherwise requested in writing.
11. Refunds
Due to the custom and technical nature of services provided, completed labor, consultation time, configuration work, troubleshooting, setup, development, design work, and digital services are generally non-refundable once performed.
12. Limitation of Liability
Franklyn Solutions shall not be held liable for indirect, incidental, consequential, lost-profit, downtime-related, business interruption, or data-loss damages arising from services provided.
13. Acceptance of Terms
Payment of an invoice, scheduling of services, continued use of services, written approval, or acceptance of completed work constitutes acceptance of these Terms of Service.
